DailyBAC provides remote alcohol monitoring services through a mobile application and BACTrack breathalyzer device. Services include three (3) scheduled daily testing windows:
A 30-minute grace period follows each window. Tests submitted during the grace period are marked as "LATE" but still recorded. All tests are recorded via your smartphone's front-facing camera with timestamped video evidence stored securely in the cloud.
Initial Enrollment Fee: $169.99 — Includes first month of service, BACTrack Mobile breathalyzer device, app onboarding, and representative dashboard access. Non-refundable once service begins. Device becomes your property immediately upon delivery.
Monthly Service Fee: $119.99/month — Due on the same date each month via automatic credit/debit card charge through Stripe. First monthly charge occurs 30 days after enrollment.
By enrolling, you expressly authorize DailyBAC and Stripe, Inc. to automatically charge your card on file each month. A $25 late fee applies after 5 days of non-payment. Service is suspended after 10 days of non-payment and your representative is notified.
If you initiate a chargeback for a legitimate charge, you are responsible for the $15 chargeback fee plus the original amount. Replacement devices are available for $100.
This is a month-to-month agreement with no long-term contract. Either party may terminate with 30 days written notice to [email protected]. You are responsible for fees during the notice period. DailyBAC may immediately terminate service for fraud, tampering, non-payment (30+ days), or violation of this agreement. No refunds for partial months.
You agree to: maintain a smartphone with a working camera and internet; keep your phone charged during testing windows; complete all tests during scheduled windows with your face visible and device in frame; not tamper with the device or app; provide accurate information; and report any issues immediately.
We agree to: provide a functioning mobile app for iOS and Android; deliver your device within 5 business days; maintain secure cloud storage; transmit results within 1 hour; target 99% uptime; respond to support within 24 business hours; and replace defective devices within 30 days (one-time).
We collect BAC results, video recordings, timestamps, device identifiers, contact information, and billing records. Your designated representative has full access to all test data. Upon termination, data is retained for one (1) year, then permanently deleted. All data stored on Google Firebase with enterprise-grade encryption. DailyBAC is a monitoring tool only. We are not responsible for legal outcomes, court decisions, representative actions, internet interruptions, or device issues. This service does not guarantee favorable legal outcomes and does not replace attorney advice. Total liability is limited to fees paid in the prior 3 months. No liability for indirect, incidental, or consequential damages.
Neither party is liable for failures caused by natural disasters, government orders, third-party outages (Apple, Google, Firebase, Stripe, BACTrack), internet infrastructure failures, app store removals, war, or civil unrest.
All IP remains DailyBAC's property. You receive a limited, non-exclusive license to use the app during active service. You may not reverse engineer, share credentials, or redistribute the service.
You are solely responsible for understanding your court requirements. DailyBAC does not interpret court orders. Confirm with your representative before enrolling.
This Agreement is governed by the Federal Arbitration Act and, to the extent not preempted, the laws of the State of Texas, without regard to conflict of law provisions. Any disputes that cannot be resolved informally within 30 days shall be resolved through binding arbitration administered under the rules of the American Arbitration Association (AAA). Arbitration shall take place in the county where the Customer resides, or remotely via video conference at the Customer's election. Each party shall bear their own costs. Either party may bring claims in small claims court if the claim qualifies. Class action waiver: all disputes must be brought in an individual capacity, not as a plaintiff or class member in any purported class or representative proceeding.
Agreement may be updated with 30 days notice. Electronic signatures are legally binding under the E-SIGN Act and UETA. If any provision is found invalid, the rest remains in effect. This agreement constitutes the entire agreement between parties. DailyBAC LLC is organized under the laws of the State of Texas. This service is available throughout the United States.
